Court to rule whether to release rally driver Maxine Wahome on bail

The High Court is today set to determine whether to release rally driver Maxine Wahome on bail ahead of her trial for the murder of her boyfriend Assad Khan.

A probation report presented to the court yesterday recommended her release on bail despite a strong opposition from Khan’s family.

The report, presented to High Court Judge Lillian Mutende, argues that Wahome is of good character, has no criminal history, and is unlikely to interfere with witnesses.  

The probation officer added that the court could grant bail with stringent measures in place to protect the safety and emotional well-being of the victim’s family. 

Wahome, the reigning national junior rally champion, has been in custody for three weeks since she was charged with the murder of Khan on December 12, 2022, at Preston Court in Kilimani, Nairobi.  

The prosecution and Khan’s family have opposed her application for bail, arguing that she did not take care of Khan after the injury that led to his death, refused to visit him in hospital or attend his funeral. 

 They further claimed that Wahome is likely to interfere with witnesses and the victims who are still grieving the loss of their loved ones. 

In a pre-bail report filed in court, Khan’s brother Adil Khan expressed his family’s opposition to Wahome’s release, saying that the two families are now worst enemies.  

He also denied claims by Wahome that he was taking her sponsorship money alongside his late brother. 

Adil stated that the two families were well-known to each other, with their convergence having been motorsport. 

Adil Khan expressed the pain that his family had endured since the sudden loss of his brother, saying, “Everything happened so fast, unexpectedly. One moment the two families are all happy and celebrating in a rally, and the next they are the worst of enemies.” 

 According to the report, Maxine had been in a relationship with the deceased for three years and had been staying together at the deceased’s rented apartment at Oloitokitok road in Kileleshwa for one year and six months.
