The Directorate of Criminal Investigations (DCI) has advised the Office of the Director of Public Prosecutions (ODPP) to initiate charges against several politicians associated with Deputy President Rigathi Gachagua. This follows their involvement in the anti-government protests that erupted on June 25, 2024.
In a recent communication, DCI’s Director of Investigations, Abdalla Komesha, revealed that the agency commenced its inquiries based on intelligence reports indicating plans for organizing and funding violent demonstrations across the country.
Investigations led to the identification of two Members of Parliament and several aides to the Deputy President, who were found to have participated in discussions at a Nairobi hotel prior to the protests. All implicated individuals have been questioned by the DCI.
The DCI has proposed that some of these individuals face charges for soliciting or inciting others to commit offenses, in violation of Section 391 of the Penal Code. Furthermore, the implicated MPs and aides may also be charged with conspiracy to commit a felony under Section 393 of the Penal Code if the ODPP concurs with the recommendations.
Additionally, one of the MPs is expected to face further allegations of money laundering.
Komesha’s letter to the ODPP, dated September 24, states, “Efforts are being made to obtain all financial data from FRC, Safaricom, and banks associated with the financial transactions in question.”
Currently, the ODPP is reviewing the case file before making a determination on the proposed charges. This development comes amid ongoing discussions regarding the potential impeachment of the Deputy President, focusing on alleged legal violations.
