Prominent and outspoken city lawyer Donald B. Kipkorir has won a temporary victory against the exclusive Muthaiga Country Club in what media outlets have called a ‘discrimination case’.
The High Court, under Justice Chacha Mwita, has granted a conservatory order allowing Kipkorir access to the club when invited by a member, despite ongoing tensions.
Kipkorir, who has never applied for membership, filed a petition accusing the club of discrimination.
His lawyer, Patrick Wanyama, hinted at deeper issues, stating, “At the right time, we will demand to know the immigration status of the board members,” suggesting that the predominantly white board may be practicing racial or tribal bias.
The dispute stems from two incidents—one in 2022 and another in August 2024—where Kipkorir was denied entry despite being invited by members for client meetings.
He claims this not only affected his professional obligations but also disrupted family gatherings, as he was barred from dropping off or picking up his children at the club.
In his petition, Kipkorir painted a picture of mistreatment, comparing his experience to colonial-era segregation. He described being treated “like a stray dog” by the club’s security and argued that the club’s actions resemble that of a “colonial entity.”
Kipkorir is not only seeking damages but also a permanent court order preventing the club from denying him access in the future, stating, “Muthaiga Country Club cannot continue to operate like a colonial relic in modern-day Kenya.”
