The Director of Public Prosecutions (DPP), Renson Ingonga, has called for the conviction of former Kiambu Governor Ferdinand Waititu and his wife Susan Wangari Ndungu over the alleged misappropriation of Sh588 million from Kiambu County.
The case revolves around a fraudulent multi-million-shilling contract awarded for road upgrades during Waititu’s tenure as governor.
The prosecution argues that the tender process was marred by corruption, with Waititu, his wife, and three other individuals—former Kiambu Transport Chief Officer Luka Mwangi Wahinya, businessman Charles Chege Mbuthia, and two companies—illegally manipulating the process to favor close associates.
The charges against them include theft, corruption, money laundering, and abuse of office, specifically in relation to a Sh588,198,328 tender awarded in February 2018 for upgrading roads to bituminous standards.
Testimony Enterprises Limited, the company that was awarded the tender, is said to have been improperly selected.
The prosecution presented 32 witnesses and 129 exhibits to support the charges. Key evidence includes claims that during this time, Waititu and his wife received Sh25 million from Testimony Enterprises via their company, Saika Two Estate Developers Limited.
Wahinya, the Transport Chief Officer, is accused of improperly awarding the contract, while Waititu allegedly had an indirect private interest in the tender process.
Senior Assistant Director of Public Prosecutions, Vincent Monda, urged the court to convict Waititu, his wife, and the other co-accused for their involvement in the corrupt scheme. Magistrate Nzyoki has scheduled the judgment date for February 11, 2025.
