A university student, David Oaga Mokaya, who is facing charges for allegedly publishing false information and sharing a misleading image of a funeral procession on Twitter, is now urging the Director of Public Prosecutions (DPP) to review the charges against him.
Through his lawyer, Danstan Omari, Mokaya questioned whether President William Ruto would be called to testify in the case.
“The student is accused of posting a casket on Twitter. I have formally requested the DPP to reconsider the charges, emphasizing the citizen’s constitutional right to critique their leaders, including the president,” Omari told the court.
The Law Society of Kenya (LSK) has also joined the case, raising concerns about its jurisdiction and whether President Ruto will be summoned as a witness.
“The accused was arrested in Eldoret, so the issue of jurisdiction must be addressed. Additionally, the president has not been listed as a witness, and we seek clarity on whether he will be called to testify,” the LSK representative stated during the court session.
The court has scheduled a mention of the case on January 28, during which the question of jurisdiction will be determined.
