NAIROBI, Kenya — A Milimani court has temporarily halted the burial of former KCB Bank Head of Data Protection Rosemary Chemutai Koech Kimwatu following an application by her husband, Kevin Migwe Kimwatu.
Senior Principal Magistrate Agnes Mwangi issued interim orders on Friday, August 28, 2026, restraining family members, relatives and KCB Bank from removing Kimwatu’s body from Lee Funeral Home or proceeding with funeral arrangements without her husband’s direct involvement and consent.
The orders have disrupted plans for her burial, which had initially been scheduled for Saturday, August 29, 2026, at her parents’ home in Chepseon, Kericho County.
Husband Challenges Funeral Arrangements
Kevin Migwe Kimwatu told the court that he married Rosemary in August 2013 and accused her family and former employer of excluding him from the funeral arrangements.
He moved to court seeking to be involved in decisions concerning the handling and burial of his wife’s remains.
The court has, in the meantime, barred the respondents from proceeding with funeral arrangements without his participation and consent.
The dispute comes as the family continues to mourn Kimwatu, who was found dead at her home in Ngong, Kajiado County, on August 21.
A post-mortem examination conducted by Chief Government Pathologist Dr Johansen Oduor established that she died by suicide.
Kimwatu, who was 40, had served as KCB’s Head of Data Protection and previously worked in Kenya’s technology, legal and digital policy sectors.
The latest court orders mean that her burial arrangements remain on hold pending further proceedings and determination of the dispute over her remains.
