DCI Arrests Nairobi Advocate Over Alleged Sh49.4 Million Land Purchase Fraud

Detectives from the Directorate of Criminal Investigations (DCI) have arrested a Nairobi advocate over allegations that he fraudulently converted Sh49.4 million entrusted to him for the purchase of land.

According to a statement issued by the DCI, Ally Ahmed Ally, an advocate practising under Rasheed Rage and Nassir Advocates, was arrested in Kilimani Sub-County and is being held on suspicion of stealing by agent, contrary to Section 283(b) of the Penal Code.

The suspect remains in police custody and is expected to be arraigned in court once investigations and processing are completed.

Client Reportedly Paid Sh49.4 Million for Land Transaction

According to investigators, the complainant transferred a total of Sh49,400,500 to the advocate in several instalments between November 16, 2023, and January 3, 2024.

The money was allegedly intended to facilitate the purchase of a parcel of land in Nairobi.

The DCI alleges that instead of completing the transaction, the advocate unlawfully converted the funds for personal use.

The allegations have not yet been tested in court, and the advocate has not entered a plea.

Investigation Underway

The DCI said the arrest followed investigations into the reported loss of the funds.

Detectives are investigating the movement of the money and the circumstances surrounding the failed land transaction before presenting the case in court.

The offence under investigation falls under Section 283(b) of Kenya’s Penal Code, which deals with allegations of theft by an agent entrusted with another person’s property.

Law Firm Named in Investigation

The DCI identified the suspect as an advocate practising under Rasheed Rage and Nassir Advocates, a Nairobi law firm that offers legal services in several practice areas, including property transactions.

The investigation relates to allegations against the individual advocate. The DCI statement reviewed for this report does not allege wrongdoing by the law firm itself.

Sauce.co.ke was unable to establish whether the advocate or the law firm had responded publicly to the allegations by the time of publication.

Suspect Yet to Take Plea

The advocate is expected to appear before court to answer the allegations.

At this stage, the allegations remain under investigation, and no court has determined the criminal charges.

Under Kenya’s criminal justice system, every accused person is presumed innocent unless proven guilty in a court of law.

The case is expected to provide further details once the prosecution formally presents the evidence before the court.
