A Nairobi businessman was arrested and charged in court for committing an unnatural act with a homeless man with the pretext that he was going to cleat rent arrears.
Peter Maina, 42 appeared before Chief Magistrate Lucas Onyina where he was charged that on September 6, 2023, at around 1 am in Kirinyaga Road, Samana Guest House in Nairobi raped the victim whose name we cannot reveal for legal reasons.
Homosexuality is prohibited under the Penal Code 1930. The code criminalises acts of carnal knowledge against the order of nature and gross indecency, with those culpable liable for 14 years in jail.
According to the police, the victim was loitering in Nairobi’s Central Business District (CBD) after his house was locked by the landlord over accumulated rent arrears. With nowhere to spend the night, he was walking around the city when he met Maina at the Simba Coach Bus Stage in downtown Nairobi.
Maina then offered to rent a room where they spent the night together and promised to clear the victim’s rent arrears.
He then secured a room at the Samana Hotel. They both slept in the same bed.
In the middle of the night, however, the victim woke up at night and found the accused person on his back with his innerwear removed and pulled downwards. Having been found red-handed, the suspect pleaded with the victim not to tell anyone what had transpired.
They then went back to sleep until the morning.
However, at day break, the victim reported the matter at the Central Police Station in Nairobi.
