A legal battle is brewing as lawyer Danstan Omari seeks compensation from Gender, Culture, Arts, and Heritage Cabinet Secretary Aisha Jumwa for his legal services in two prominent cases.
In the first case, Omari is requesting a substantial sum of Ksh. 9,860,000 for his representation of Aisha Jumwa in a murder case, specifically High Court criminal case No. E011 of 2020. This amount encompasses various expenses and services, including:
- Legal instructions for the murder case.
- Examination and analysis of the state’s affidavit opposing bail.
- The preparation and submission of a notice of motion application under a certificate of urgency.
The twist in this case is that Aisha Jumwa, initially facing murder charges, had those charges dropped by the Director of Public Prosecutions, subsequently becoming a prosecution witness.
Corruption Case
Notably, Omari had originally sought a larger sum of Ksh. 17.4 million as fees for representing Jumwa in a corruption case. However, recent court documents filed at the Mombasa Law Courts reveal that the lawyer now requests Ksh. 10 million to cover various legal services, including:
- Legal instructions and representation in the corruption case.
- The drafting and filing of a range of legal submissions and notices of motion.
- Managing correspondence, including receiving and reviewing a letter from the Director of Public Prosecutions.
- Attendance at court sessions for hearings and mentions related to the corruption case.
In addition to these core legal fees, the lawyer has itemized various miscellaneous expenses, covering items such as printing, binding, and telephone services, all of which were incurred during the course of representing Aisha Jumwa in these two high-profile cases.
