John Matara’s bail postponed after prosecution fails to avail probation report

John Matara’s bail hearing in his robbery with violence case has been delayed due to a delay in submitting his probation report to the court.

Ruiru Magistrate Charles Mwaniki made the decision on Tuesday when the Probation Officer failed to present her report in court.

Back in March, Magistrate Mwaniki had instructed the officer to provide a report to assist the court in determining the appropriate bail or bond amount for Matara’s release.

However, on Tuesday, Probation Officer Margaret Manda informed the court that while the report was already prepared, it could not be submitted to the court.

She further explained that the county director had not yet approved it, and it also required approval from the regional officer before being presented to the court. Manda requested an additional two weeks to facilitate this process.

Meanwhile, Matara’s lawyer, Samwel Ayora, assured the court that he would use the time to gather necessary documents from the prosecution today. The state did not object to these requests.

In response, Magistrate Mwaniki directed the Probation Office to submit the report by April 24, coinciding with a mention on the hearing date.
