An Eldoret court has slapped a third-year law student at the University of Nairobi with a Ksh.7.5 million fine in connection with the cyber harassment charge as read under the computer misuse and cybercrime Act No 5 of 2018.

The Court awarded Benard Kagia, a driver attached to Prophet David Owuor of the Repentance and Holiness Ministry, Ksh.7.5 million in a defamation case he filed against Facebook user Kevin Ndung’u Kiriga. The conflict began after the law student called Kagia a prostitute on his Facebook post three years ago.

The court also heard that Kiriga made another post on Facebook claiming that the driver was “unable to take care of his family.”

Kiriga’s accusations of infidelity led to the breakdown of the marriage between Kagia and his wife.

Feeling hurt by what he described as “defamatory and harmful” posts, Kagia took the matter to court and filed a libel case against the third-year law student from the University of Nairobi.
