A middle-aged man from Nanyuki, Laikipia County, has been sentenced to 40 years in prison for defiling a 10-year-old girl and intentionally infecting her with HIV/AIDS.
The perpetrator committed this heinous act in May 2023 at Makandura in Laikipia North sub-county.
During the ruling, Senior Principal Magistrate Ben Mararo of the Nanyuki Law Courts emphasized that the testimony of the four witnesses presented by the prosecution unquestionably proved the guilt of the accused in committing the crime.
Section 26(1) of the HIV and AIDS prevention and control act (2006) makes it illegal for a person who knows they have HIV to intentionally, knowingly, and wilfully do anything or permit anything to be done which they should reasonably know will or is likely to transmit HIV.
