Environment CS Soipan Tuya Sues Husband for Child Support

In a surprising turn of events, Environment Cabinet Secretary Soipan Tuya has taken legal action against her ex-husband, Stephen Saibulu Kudate seeking Ksh.425,000 monthly upkeep to cover her children’s school fees and maintenance.

However, this is not just about financial support. Tuya has also requested court orders to restrict Kudate from accessing her children, her home, their school, or any other location related to their well-being.

Tuya, in a certificate of urgency, claims to be living in fear due to the abusive nature of her ex-husband.

She states that not only she but also her children and domestic workers have been subjected to relentless cruelty, psychological and emotional abuse, as well as verbal mistreatment.

Protecting Well-Being

Tuya firmly believes that Kudate poses a significant threat to her well-being, that of her children, and her domestic workers. Hence, her appeal to the court to take immediate action.

The CS has also requested orders for the actual care and control of her two minor children.

In the unfortunate event that the court cannot grant her this wish, she seeks restrictions and supervised visitation rights for Kudate concerning the minors.

A Broken Love Story

The court papers shed light on the couple’s history.

Soipan Tuya and Stephen Saibulu Kudate cohabitated from December 21, 2013. They maintained a relationship until October 2020 when they claim to have grown apart.

Kudate then moved out of Tuya’s home and returned to his wife, causing a separation between the two.

“The plaintiff and the defendants hence lived separately, their association having been frustrated and brought to a quick end by the continuous refusal of the defendant to take responsibility towards upkeep and maintenance of the minor children as well as various incidences of violence, abuse, and infidelity by the defendant,” the court documents read.

Seeking Legal Intervention

Tuya emphasizes that since the beginning of their relationship and their subsequent split, Kudate has failed and refused to contribute to school fees and other school-related expenses for the children, despite having the means to do so.

She further asserts that her petition to the court is a result of Kudate’s failure to fulfill these responsibilities.

The matter is scheduled for mention on November 13.
