Agriculture Cabinet Secretary Mithika Linturi faced a setback on January 29 as the court rejected his plea for Sh 10 million in damages over an alleged malicious arrest and subsequent detention.
On October 7, 2022, Linturi filed a lawsuit against the director of public prosecution, the director of criminal investigations, the national cohesion and integration commission, and the attorney general, accusing them of violating his constitutional rights.
The lawsuit stemmed from the failure of the prosecution to charge him after the conclusion of investigations within the court-granted two-month period. The judge at Nakuru High Court also refused to prevent the state from continuing its investigations and pursuing criminal charges against Linturi.
Linturi, the then Meru senator, had been arrested on January 8, 2022, following statements he made earlier in the day during a public rally organized by the United Democratic Alliance Party (UDA) in Eldoret, Uasin Gishu County.
