A resident of Kericho has formally lodged a complaint with the Judicial Service Commission (JSC) against Justice M.C. Oundo over summons issued for their elderly and sick mother.
Gilbert Koech, the complainant, has taken issue with Justice Oundo for summoning his 100-year-old mother, Penina Nyambura Too.
According to Koech, his elderly mother is required to appear before the court for sentencing in a land dispute involving his stepbrother.
Koech expressed concern about the health of his ailing mother, who is confined to a wheelchair, being summoned to court alongside her two sons to face sentencing.
The case revolves around allegations that the family defied court orders in a succession case related to disputed land, resulting in Nyambura Too’s eviction.
According to the complaint submitted to the JSC, the legal team representing Nyambura Too, led by Danstan Omari, asserted that Gilbert Koech had been evicted from the disputed land. They claim to have provided a detailed explanation to the court, arguing that Koech was not in possession of the land.
However, despite this explanation, the court allegedly found Koech in contempt of court orders and directed that he, along with his aged mother, appear in court for sentencing.
“The judge pronounced that Gilbert and his family, including Penina the woman, Livingstone Koech, an administrator, and Charles Koech should appear for mitigation and sentencing on the 7th of next month,” the letter to the JSC explains.
In light of the circumstances, the family is urgently requesting the JSC to review the case file to alleviate the imminent apprehension of arrest.
Additionally, they are calling for a thorough investigation into Justice Oundo’s conduct in this matter.
