Nairobi, Kenya – August 4, 2025 –
Former Baringo Central Member of Parliament Sammy Silas Komen Mwaita was arrested on Sunday in connection with an ongoing probe into a multi-million shilling land fraud scandal involving public land parcels in Nairobi and Nakuru counties.
Ex-MP to Face Multiple Criminal Charges
Mwaita is expected to appear in court on Monday, August 4, where he will face multiple charges, including:
- Conspiracy to commit a felony
- Making a document without authority
- Abuse of office
- Giving false information to a person employed in the public service
According to police sources, Mwaita was apprehended in Kilimani and later transferred to Muthaiga Police Station for processing ahead of his arraignment.
Land Fraud Linked to Nairobi West Plots
The arrest follows directions from the Office of the Director of Public Prosecutions (ODPP), related to two land parcels located along Mai Mahiu Road in Nairobi West, both worth millions of shillings. Investigators suspect irregular dealings and fraudulent documentation involving the said properties.
EACC Probes Deeper into Land Misuse
The Ethics and Anti-Corruption Commission (EACC) is also conducting a parallel probe into alleged:
- Abuse of office
- Conflict of interest
- Fraudulent acquisition of public property
These allegations stem from Mwaita’s tenure as Commissioner of Lands, a position he held prior to joining elective politics.
According to the EACC, one key transaction under scrutiny involves the alleged illegal allocation of public land in Nakuru to Mwaita’s brother. The land in question is currently under development by the Kenya National Highways Authority (KENHA), which is setting up its regional headquarters on the property.
The EACC has since filed a suit at the Environment and Land Court to reclaim the public land and has obtained an injunction prohibiting any dealings until the matter is fully determined.

Accomplice Still at Large
Detectives say the search for Mwaita’s alleged accomplice is ongoing. Authorities believe the unnamed suspect played a role in the execution or facilitation of the fraudulent transactions.
