The High Court has ordered the government to seize assets worth KSh 76.2 million allegedly owned by former Kiambu Governor Ferdinand Waititu, in a major blow to the embattled politician.
Justice Nixon Sifuna ruled that Waititu and his wife, Susan Ndung’u, failed to satisfactorily explain the source of several high-value properties and assets, prompting the court to partially allow a case filed by the Ethics and Anti-Corruption Commission (EACC).
Among the assets ordered forfeited to the state are two parcels of land valued at KSh 32 million, a Caterpillar machine worth KSh 11 million, and two vehicles valued at KSh 600,000 each. One of the land parcels belongs to Waititu’s wife and has also been returned to the government.
The court, however, rejected EACC’s attempt to confiscate funds held in multiple bank accounts linked to Waititu, his wife, and their companies, citing insufficient evidence and lack of clarity in the commission’s claims.
EACC had initially sought to recover assets worth KSh 1.9 billion, alleging they were illegally acquired during Waititu’s tenure as Kiambu governor. The court ruled that only assets whose source could not be credibly explained would be forfeited.
Waititu and his wife had opposed the case, insisting the properties were acquired legally through business income and loans long before he assumed office.
The ruling comes months after Waititu was convicted in February 2025 in a KSh 588 million conflict-of-interest graft case, where he was sentenced to 12 years in prison or a fine of KSh 52.5 million. His wife received a one-year jail term or a KSh 500,000 fine.
