A night of drinking by three best friends turned into a nightmare for a woman who had joined them after she was raped in turns for a whole night.
According to the police, the woman was drinking with his boyfriend and two of his friends at a local pub in Umoja, Nairobi on the night of January 15, 2023.
At one point, during the night one of her boyfriend’s buddies whose name the victim cant recall excused herself and went home. Later another friend by the name Ndaya Kassim Owino joined them at their table.
Hours later when the bar’s attendants told them they were closing for the day, the three left together with the intention of spending the rest of the night at Owino’s house.
However, along the way, they were joined by another man who is listed in police records as Issa Odhiambo Suleiman, who persuaded them to go to his house as it was nearby. They bought some miraa and more alcohol along the way which was to be consumed at Issa’s house.
Once in the house, the merrymaking continued for some hours until they ran out of alcohol. The men started arguing over who among themselves was going to provide the money for the new round of drinks. During the argument, the victim’s boyfriend got fed up and went home leaving his woman with his three friends in Issa’s house.
The victim said she blacked out moments later. She woke up the next day at around mid day and found herself at Issa’s bed alone. She did not immediately notice that anything had happened to her. Issa told her to leave as he wanted to go to work and she left.
However along the way home she felt some pain in her private parts. She informed her boyfriend that she suspected that she had been raped by Owino and Issa because if the pain.
The two organised a meeting with Owino and Issa over the matter where they agreed that they had raped her in turns for a whole night.
She immediately sought treatment and reported the matter at the Buru Buru police station. Police immediately arrested Issa and Owino and brought them in for interrogation.
On Friday, the two men were were charged with sexual assault contrary to section 10 of the Sexual Offences Act (SOA) of 2006. If found guilty they are liable for a prison sentence of not less than 15 years.
They however denied the charges before Senior Resident Magistrate Mercy Malingu at the Makadara Law Courts. In their defence they said that the victim only lodged a complaint because her boyfriend learnt that she had willingly had sex with them.
The Magistrate released them on a bond of Sh500,000 without an option of a cash bail. The case will be mentioned on February 15, 2023 before hearing starts on April 5, 2023
