Nancy Kigunzu, known as ‘Mathe wa Ngara,’ appeared in the JKIA law court seeking bail on the grounds of her deteriorating health.
During Monday’s bail application hearing, Kigunzu suffered a collapse, emphasizing her need for ongoing medical attention and expressing concerns about the potential exacerbation of her condition if she remains in custody.
Addressing Magistrate Njeri Thuku, Kigunzu dismissed claims that she poses a flight risk and intends to evade court proceedings.
Represented by lawyer Danstan Omari, Kigunzu maintained that her arrest occurred within the city, while her children were apprehended at their residence, underscoring her ties to her home and familiarity with the police.
Contrary to assertions that she might tamper with witnesses, Kigunzu contended that all witnesses in the case are police officers and her influence over them is nonexistent.
Co-accused Teresia Wanjiru and two others joined Kigunzu in court, also seeking release on bail. Their legal representatives argued that the prosecution lacks compelling reasons to justify their continued remand.
The prosecution, however, opposed bail, citing concerns about societal influence. Their affidavit stated, “The accused persons be isolated from society so they do not continue poisoning the society in which they live in.”
Investigator Stephen Chesire countered the bail requests, expressing concerns about flight risks and the accused’s unknown places of residence. Chesire argued that their release might hinder ongoing investigations and hinder the compilation of evidence.
The prosecution emphasized the existence of substantial evidence against the accused and the potential for additional arrests based on statements from crucial witnesses.
As legal proceedings continue, Kigunzu’s health concerns and the prosecution’s determination underscore the complexity of the case.
