Rosemary Kimwatu’s Husband Withdraws Court Case Over Her Burial

NAIROBI, Kenya — Kelvin Kimwatu, the husband of former KCB employee Rosemary Chemutai Kimwatu, has withdrawn the court case he filed in connection with her burial.

Through his lawyer, Kimwatu informed the court that he would no longer pursue orders seeking the exhumation of Rosemary’s body or proceed with contempt of court proceedings arising from the circumstances surrounding her burial.

The decision marks a new turn in the dispute that had emerged between Kimwatu and Rosemary’s family over her final resting place.

A Milimani court had previously issued interim orders stopping Rosemary’s burial without the involvement and consent of her husband. Despite the orders, her family proceeded to bury her at their home in Chepseon, Kericho County, prompting Kimwatu to move back to court.

Kimwatu had argued that he was excluded from key decisions concerning the funeral arrangements and had sought the court’s intervention over the burial.

His latest decision to withdraw the case means he will no longer seek to have Rosemary’s remains exhumed or pursue contempt proceedings against those involved in the burial.

Rosemary, a former KCB Head of Data Protection, died on August 21, 2026, with her death having sparked public attention and a separate dispute surrounding her workplace and family circumstances.
