A Nairobi court has ordered the release of businessman Ben Gethi, former PS Peter Mangiti, former NYS Director General Nelson Githinji, and several other individuals involved in the Ksh. 791 million case.
However, Josephine Kabura, a businesswoman, and four others implicated in the corruption allegations will have to face a trial to defend themselves.
Magistrate Wendy Micheni, in her ruling on Monday, cited insufficient evidence presented by the prosecution to establish a direct link between the accused and the alleged theft.
She further noted that the prosecution’s case relied on general information without adequate support from electronic or documentary evidence.
“Having failed to establish a prima facie case against the accused persons, I hereby acquit them for lack of evidence,” declared the magistrate.
The prosecution had called over 50 witnesses to testify against Mangiti and the other accused when they were charged in 2015 with conspiracy and money theft.
