Chief Justice Martha Koome has announced the dismissal of a magistrate from service due to allegations of gross misconduct.
In a statement released on Wednesday, Koome stated that the Judicial Service Commission (JSC) had exercised its disciplinary mandate over judicial officers and staff as outlined in Article 172 (2) (c) of the Constitution.
The magistrate in question, identified as Patrick Wambugu was accused of irregularly altering bond terms, resulting in the release of an individual who had been charged with the defilement of a six-year-old child.
CJ Koome added that the accused person has since absconded bail after being granted freedom.
In related news, a judge of the Environment and Land Court is currently facing removal over allegations of gross misconduct and incompetence.
Justice Mohamed Noor Kullow is also facing accusations of violation of the Judicial Service Code of Conduct.
In a statement on Wednesday, Chief Justice Martha Koome said the Judicial Service Commission on diverse dates received a total of five petitions for his removal.
Koome added that the Commission had petitioned President William Ruto to appoint a tribunal in accordance with Article 168 (4) and (5) of the Constitution. Article 168(5) provides that the president shall, within 14 days after receiving the petition, suspend the judge from office.
The president is then required to appoint a tribunal consisting of a chairperson and three other members including one advocate of fifteen years standing and two other persons with experience in public affairs to listen to the petition.
