A Nairobi court has summoned Kasarani DCIO Paul Makonge to appear in court in June regarding the failure to produce a police file in the case involving DJ Brownskin, also known as Michael Macharia Njiiri. The DJ is charged with aiding his wife Sharon Njeri’s suicide on July 29, 2022.
During the hearing on Thursday before Milimani Principal Magistrate Gilbert Shikwe, it was revealed that neither the police file nor the investigating officer was present in court. The prosecution sought an adjournment and requested the issuance of a summons to the DCIO Kasarani.
The prosecution explained that the investigating officer had been transferred, causing delays in the case. However, defense lawyer Duncan Okatch expressed frustration, noting that this was the second time the hearing had been delayed due to the absence of necessary documents and personnel.
This was the second instance where the police file was missing. Previously, on April 3, the court had summoned the investigating officer to appear with the file. Magistrate Shikwe emphasized the importance of the case, questioning the absence of crucial documents and witnesses.
“I issue orders to summon the DCIO Kasarani to appear in court on June 5 to explain the whereabouts of the police file, failure to which I will issue a warrant of arrest,” ruled Magistrate Shikwe.
DJ Brownskin has denied the charges of aiding his wife’s suicide and faces additional charges, including failing to prevent her suicide and destroying evidence from his phone. The father of the deceased was scheduled to testify on Thursday.
The case will be mentioned again on June 5 as the court seeks resolution on the missing police file and progresses with the proceedings.
