Gatundu South MP Gabriel Gathuka Kagombe, commonly known as G.G. Kagombe, was arraigned in Machakos High Court on Monday, facing charges of murder contrary to Section 203, as read with Section 204 of the Penal Code.
The charges allege that on May 17, 2024, at around 4:30 p.m., Kagombe murdered David Nduati Wataha in the Kimuchu area of Makongeni, Thika West, Kiambu County.
Represented by a team of lawyers, Kagombe did not enter a plea during the court proceedings. High Court judge Francis Olel ordered that Kagombe undergo a mental assessment and be taken to Kiambu Level 5 Hospital on Wednesday, June 5.
“The accused should be released on anticipatory bond terms issued in Kiambu HRCC miscellaneous application no 804 of 24,” Judge Olel stated. However, the state counsel opposed this on the grounds that the anticipatory bail was no longer applicable, as formal charges had already been filed. The counsel argued that Kagombe would need to apply for new bail or bond terms once formally charged before the High Court in Machakos.
Addressing the matter of jurisdiction, the judge noted that the High Court has authority across the entire country.
The court ordered that Kagombe return on Friday, June 7, at 10:00 a.m. for plea-taking and that he be remanded at Muthaiga Police Station in the interim.
