Judge who presided over Finance Act petition among those transferred

In the latest series of changes within the Judiciary, High Court Principal Judge Eric Ogolla has announced the transfer of 13 judges, in various divisions within the Judiciary.

Among the notable relocations on Tuesday, August 8, was that of High Court Judge David Majanja.

Majanja previously presided over petitions challenging the Finance Act, 2023. His move entails a transition from the Commercial and Tax Division to the Civil Division, which specializes in handling civil cases revolving around contract disputes and tort claims.

The statement issued also stated that the Judicial Service Commission is entrusted with the responsibility of upholding the autonomy and accountability of the Judiciary.

“The Judicial Service Commission is mandated to promote and facilitate the independence and accountability of the Judiciary and the efficient, effective and transparent administration of justice under Article 172 of the Constitution,” the statement read in part. 

In his new capacity, Justice Majanja will not only be tasked with resolving property disputes but also handling cases relating to family law, employment law, and civil constitutional law matters.

Other changes

Other judges affected by the reshuffling include Lady Justice Hedwig Ong’udi, who has been transferred from the Constitutional & Human Rights Division to Nakuru High Court.

Similarly, Lady Justice Mugure Thande, previously stationed at the Constitutional and Human Rights Division, now assumes duties at the Malindi High Court.

Further changes include Justice Hillary Chemitei’s move from the Nakuru High Court to the Family Division and the relocation of Lady Justice Maureen Odero from the Family Court to the Nyeri High Court.

In other changes, Justice Chacha Mwita, formerly serving within the Commercial and Tax Division, has been reassigned to the Constitutional and Human Rights Division.

Lady Justice Teresa Odera (Kisii High Court) and Justice Peter Mulwa (Commercial and Tax Division) at Milimani in Nairobi have also been moved.

The list of changes extends to Lady Justice Florence Muchemi, now stationed at Thika High Court; Lady Justice Diana Rachel Kavedza, assigned to Kibra and Kahawa Law Courts; and Lady Justice Patricia Gichohi, taking on responsibilities at Nakuru High Court.
