Mama Ngina Kenyatta Sues Attorney General Justin Muturi Over 1000 Hectares Taita Taveta Land

Former First Lady Mama Ngina Kenyatta has taken legal action and sued the Attorney General of Kenya, Justin Muturi by filing a case demanding for the Land Registrar to issue the Kenyattas a title deed for 1,000 hectares of land in Taita Taveta County.

Court documents, seen by our media team, reveal Mama Ngina and former Taveta MP Basil Criticos are claiming co-ownership of the land.

The two assert that despite being the rightful owners, they have not received the title deed for the 1000 hectares.

In the suit, they have listed the Attorney General Justin Muturi as a respondent.

“In breach of his said statutory obligation or duty, the 1st Respondent has to date failed to issue to the applicants (former First Lady and the MP) the said Certificate of Title in relation to the said parcel of land L.R No. 10287/7 Taveta,” the court documents state.

They further contend that this failure denies them the statutory right to possess the Certificate of Title, solid evidence of their ownership.

The urgency of the matter led to Justice John Chigiti certifying it as urgent, instructing Mama Ngina and the former MP to file a comprehensive motion within 14 days.

Additionally, the court directed Attorney General Justin Muturi and the Land Registrar to respond within the same timeframe after being served by the applicants.

The case is set to be mentioned on March 5, 2024, to monitor compliance.

The Kenyattas and Basil Criticos families reportedly own over 82,000 acres in Taita Taveta, where an estimated 210,000 individuals—out of a population of 284,000—are living as squatters.

Notably, Tsavo National Park occupies 65% of Taita Taveta’s land, with private farms taking up 24%.

Locals occupy less than 12%, highlighting the broader complexity of land usage in the area.
