The Ethics and Anti-Corruption Commission (EACC) has absolved former Communications Authority of Kenya (CAK) Director General Ezra Chiloba of allegations of abuse of office and conflict of interest.
In a letter dated April 4 addressed to CAK Director General David Mugonyi, EACC CEO Twalib Mbarak stated that the commission had closed the file on Chiloba due to insufficient evidence.
“The investigation found that there was insufficient evidence to support the allegations against Ezra Chiloba and other officials of the Authority,” Mbarak’s letter stated.
However, the anti-graft body recommended the review of CAK’s Human Resource Policy and Procedure Manual.
Last September, EACC initiated an inquiry into Chiloba’s conduct following his suspension by CAK’s board chairperson, Mary Wambui.
Chiloba was accused of improperly applying for and approving a mortgage loan without following the correct procedure, among other financial irregularities.
An audit conducted on the CA’s staff mortgage revealed that the loan, used to acquire property jointly with Jacob Wakhungu, was not subjected to scrutiny and approval by a higher authority.
Additionally, he was alleged to have purchased a house and seven acres of land, exceeding the mandatory one-acre limit set by the Civil Servants Housing Scheme requirement.
The audit documents highlighted Chiloba’s actions as “Gross Misconduct,” noting that as the Accounting Officer for the Authority, his conduct contravened sections of the Leadership and Integrity Act and breached the Code of Ethics.
Despite these allegations, Chiloba was appointed by President William Ruto as Kenya’s Consul-General for Los Angeles last month.
