The High Court has allowed the planned auction of former Cabinet Secretary Raphael Tuju’s Dari Business Park to proceed, while temporarily stopping the sale of the Entim Sidai property pending the hearing and determination of the case.
Court Declines to Stop Dari Business Park Auction
In a ruling delivered by the court, the judge declined to issue stay orders blocking the auction of Dari Business Park, effectively clearing the way for the sale process to continue.
The decision marks a significant development in the ongoing legal battle surrounding Tuju’s properties and outstanding financial obligations.
Temporary Relief for Entim Sidai Property
While allowing the Dari Business Park auction to proceed, the court granted temporary orders restraining the auction of the Entim Sidai property until the matter is fully heard and determined.
The temporary protection, however, comes with conditions attached.
Tuju Ordered to Deposit KSh50 Million
The court directed Tuju to deposit KSh50 million within 30 days as security.
According to the ruling, failure to comply within the stipulated timeline will automatically lift the stay orders currently protecting the Entim Sidai property from auction.
Legal Dispute Continues
The case arises from an ongoing legal dispute involving the properties and alleged outstanding financial obligations linked to the former Cabinet Secretary.
The matter is expected to proceed to a full hearing where the court will determine the broader issues surrounding ownership, debt obligations, and the proposed auctions.
