The High Court has overturned an earlier ruling that denied bond to Nancy Kigunzu, widely known as ‘Mathe wa Ngara’, granting her freedom under strict supervision as her narcotics case proceeds.
Justice James Wakiaga allowed Kigunzu’s appeal, setting aside the decision of the JKIA Law Courts, which had previously blocked her release. The ruling marks a significant shift in a case that has drawn national attention and sparked debate over fair trial rights in Kenya’s criminal justice system.
Under the new orders, Justice Wakiaga directed that Kigunzu be released on a Ksh 500,000 bond with a surety of the same amount. She must also report to the investigating officer every 30 days, a move aimed at ensuring full cooperation with ongoing investigations.
The judge issued a stern warning, cautioning Kigunzu against engaging in any similar offence while out on bond.
These fresh terms replace those set by Magistrate Renee Kitangwa, who had earlier denied her bond application even as her co-accused, David Ochieng and Christopher Odipo, were each granted a Ksh 1 million bond.
The three were arraigned on August 12 on charges of trafficking narcotics and conspiracy to traffic narcotics, offences under Kenyan law that carry heavy penalties upon conviction.
According to the prosecution, Kigunzu was allegedly found in possession of 18.3 kilograms of cannabis valued at Ksh 6 million, evidence they say ties her directly to illegal drug operations.
Her successful appeal means she will now await trial outside custody, though under enhanced supervision.
