A Nairobi businesswoman has been charged before a Kibera court for allegedly stealing household items and maliciously damaging property worth nearly Sh1 million belonging to her former husband in Lang’ata.
Mary Waithira Gikonyo, 50, appeared before Senior Principal Magistrate Agnetta Ogonda at the Kibera Law Courts, where she denied two charges — theft and malicious damage to property.
Incident in Lang’ata’s Kumbe Road
According to court documents, the incident occurred on March 22, 2025, at a residence along Kumbe Road, Hardy, Lang’ata.
Waithira, alongside others not yet arrested, allegedly broke into her former husband’s house, Eric Munene, and caused extensive damage, including:
- The destruction of a main gate and house door,
- Several broken window panes, and
- A damaged CCTV camera.
The damaged property was valued at Sh325,000.
Stolen Items Worth Sh933,500
Prosecutors allege that Waithira also stole household electronics and valuables during the break-in, including:
- A gold Casino-brand wristwatch,
- An iPhone 14,
- A Samsung video camera,
- Three HP laptops,
- Two PlayStation gaming consoles, and
- Two wall clocks.
The total value of the stolen items was estimated at Sh933,500, bringing the total loss to Sh966,000.
Court Proceedings and Bail Terms
Through her lawyer John Swaka, Waithira maintained her innocence and urged the court to grant her lenient bail terms, insisting she was a law-abiding citizen and not a flight risk.
“Your Honour, my client is ready to comply with all the terms set by this court. She is not a flight risk and will present herself whenever required,” Swaka told the court.
However, State Counsel Ismael Nyaribo opposed bail, arguing that the accused could interfere with witnesses as investigations were ongoing.
After considering both arguments, Magistrate Ogonda ruled that bail was a constitutional right, granting Waithira release on a cash bail of Sh50,000.
“In the absence of compelling reasons, I hereby release the accused person on a cash bail of Sh50,000,” Ogonda ruled.

The case, filed under Criminal Case No. 991/2025, originated from investigations by Hardy Police Station. It will be mentioned again on November 27, 2025, for pre-trial directions.
