A fresh twist emerged at the Kisii Law Courts on Monday after seven suspects linked to the deadly Friday attack on the Linda Mwananchi convoy failed to take a plea when both the investigating officer and the prosecutor failed to appear in court.
The unexpected absence stalled the proceedings, prompting Senior Resident Magistrate Caroline Jeruto to postpone the plea and order that the suspects remain in custody until the prosecution is ready to proceed.
The seven suspects—six men and one woman—were arrested over the weekend in connection with the violent attack in Keumbu, Kisii County, which left one person dead, several others injured and multiple vehicles damaged, including one carrying former Chief Justice David Maraga.
Court Proceedings Stall
There was heightened security and tension in the packed courtroom as the suspects, dressed in hoodies and face masks, were escorted into the dock with their identities concealed from members of the public and the media.
Investigators believe the suspects are linked to the notorious Ebirongo group, which is alleged to have attacked the Linda Mwananchi convoy using stones and batons after it stopped in Keumbu while travelling to Keroka.
However, when the matter was called, neither the investigating officer nor the prosecutor was present to present the case, forcing the proceedings to an abrupt halt.
Suspects Remanded
Following the delay, Magistrate Jeruto directed that the suspects be returned to the court cells before later ordering that they remain in custody at Kisii Police Station pending the prosecution’s readiness to proceed with the case.
The plea is expected to be taken once the prosecution appears before the court.
