NAIROBI, Kenya — The High Court has issued temporary orders halting criminal proceedings against Trans Nzoia Governor George Natembeya, who is facing corruption and abuse of office allegations.
Justice Bahati Mwamuye delivered the ruling on Wednesday, suspending the case until the court rules on a petition Natembeya has filed to challenge the legality of the charges brought against him. The governor alleges that his constitutional rights have been violated in the process.
Charges Linked to Procurement Irregularities
The case against Natembeya arises from alleged procurement malpractices under his administration. The Ethics and Anti-Corruption Commission (EACC) also accused him of abuse of office, escalating scrutiny over the county’s financial management.
Court documents reveal that Natembeya is seeking to stop his prosecution entirely, arguing that the legal process against him is flawed and violates his fundamental rights.
Conservatory Orders Issued
“Pending the inter partes hearing and determination of the petitioner/applicant’s Notice of Motion Application dated June 5, 2025, a conservatory order be and is hereby issued staying the criminal proceedings in Nairobi, Milimani Chief Magistrates’ Anti-Corruption Case Number E024 of 2025, Republic versus George Natembeya & Another,” reads part of Justice Mwamuye’s ruling.
Court Directs Service of Petition
Justice Mwamuye further directed that all court documents, including the petition, application, and order, be served to the relevant parties—namely the Directorate of Criminal Investigations (DCI) and the Office of the Director of Public Prosecutions (ODPP)—by June 9, 2025.
Natembeya was present in court alongside a team of his legal and political allies, including lawyers Dan Maanzo, Ken Aseka, Jimmy Wanjigi, and George Wajackoyah, underscoring the political weight of the matter.
