TikTokers behind a viral trend mocking Raila Odinga Jnr, the son of the late former Prime Minister Raila Odinga, risk arrest following a stern directive from the Kenya National Commission on Human Rights (KNCHR).
In a statement seen by Sauce.co.ke, KNCHR condemned the TikTok challenge that targeted Raila Jnr with ridicule and trolling, terming it a gross violation of human dignity and a breach of Kenya’s Constitution and the Persons with Disabilities Act No. 4 of 2025.
“Mocking or demeaning a person with a disability is unconstitutional and discriminatory,” KNCHR stated.
The Commission cited Article 28 of the Constitution, which guarantees the right to human dignity, and Article 27, which upholds equality and non-discrimination.
It further pointed to Section 67 of the Persons with Disabilities Act, which criminalizes degrading treatment toward persons with disabilities. Offenders risk a fine of up to KSh1 million, one year in prison, or both.
KNCHR revealed it has identified several TikTok accounts that took part in the offensive challenge and plans to publicly name the individuals involved. Those responsible have been directed to issue public apologies and make written commitments to desist from such actions.
Failure to comply, the Commission warned, will result in prosecution in collaboration with law enforcement.
“We are working closely with the National Council for Persons with Disabilities to ensure full enforcement of the law,” the statement added.
KNCHR also urged social media companies to take stronger action against digital hate, bullying, and discrimination, emphasizing the need for responsible online behavior.
