Former Kiambu Governor Ferdinand Ndung’u Waititu has informed a Nairobi court that he has secured a Ksh. 53 million bank guarantee in relation to the hate-speech case for which he is facing trial. Waititu is currently serving a sentence at Kamiti Maximum Prison following a separate corruption conviction.
Appearing before Trial Magistrate Rose Ndobi on Tuesday for the mention of the case, Waititu — through his lawyer — confirmed that the bank guarantee is a critical step in his bid for release.
The court noted that upon payment of the Ksh. 53 million guarantee, Waititu may be freed, as the terms of his earlier bond in the hate-speech matter remain valid. Magistrate Ndobi scheduled the hearing for January 15, 2026.
Allegations Against Waititu
Waititu is accused of making inflammatory remarks on September 29, 2024, at Ruiru Stadium in Kiambu County. According to the charge sheet, the former governor allegedly directed statements at groups including hustlers, market vendors, boda boda operators, clergy, and teachers
Prosecutors claim the remarks were intended to provoke a breach of peace and implied violent consequences against political figures. The alleged conduct violates Section 94(1) of the Penal Code, which criminalises offensive behaviour likely to incite public disorder.
Authorities argue that the former governor’s statements were made publicly with intent to generate tension, raising concerns about political rhetoric and public safety in Kenya.
