Kisii MCA Christopher Ogoti Onsaga is facing deepening legal trouble after being charged with obtaining money through false pretenses in a case involving a fraudulent promise of a travel visa to Canada.
Ogoti, the Nyamasibi Ward representative serving his first term, appeared before Senior Resident Magistrate Joshua Nyariki, where he denied defrauding Mary Ogachi of Ksh 183,000 between February 2022 and January 2023.
According to the charge sheet, Ogoti claimed he could secure Canadian travel and job opportunities for Ogachi’s daughter, Mildred Gekonge, a claim prosecutors say was entirely false.
Prosecutor Opposes Bail Citing More Victims
Prosecutor Cleotas Akello opposed the MCA’s release on bail, stating that more complainants had since stepped forward with similar allegations.
Akello told the court that the MCA is linked to multiple complaints worth millions of shillings, warning that he may be a flight risk given the growing scale of the investigations.
Defence: Bail Is a Constitutional Right
Ogoti’s lawyer, Wilkinson Achoki, dismissed the prosecution’s objections, arguing that no supporting affidavits had been presented.
He maintained that Ogoti, as an elected public official, is “easily traceable” in Kisii County and therefore not a threat to the investigation.
Magistrate Nyariki agreed and granted him Ksh 100,000 bail.
Re-Arrested Minutes After Leaving Court
However, Ogoti’s brief moment of relief ended abruptly.
Just minutes after walking out of court, he was dramatically re-arrested by DCI Nyanchwa officers following fresh complaints filed by additional alleged victims.
Investigators say more statements are being recorded, and parallel probes are now underway as the number of complainants continues to rise.
The swift re-arrest has intensified public scrutiny of the MCA, with the unfolding allegations suggesting that his legal troubles may be far from over.
